These Terms of Use (“Terms”) govern your use of Finvision, a mobile application (“the App”) developed and operated by Vegarise(“we,” “us,” or “our”). By downloading, installing, or using Finvision, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Finvision on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes. This license is conditioned on your compliance with the Apple Standard End User License Agreement (EULA), which is incorporated into these Terms by reference.
You may not: copy, modify, or distribute the App; reverse-engineer or decompile the App; use the App for any commercial purpose; sublicense or transfer the App to any third party; or remove any proprietary notices or labels on the App.
2. App Store terms
Finvision is distributed through the Apple App Store. Your download and use of the App is also governed by the Apple Media Services Terms and Conditions. In the event of a conflict between these Terms and the Apple Media Services Terms, the Apple Media Services Terms shall govern.
Apple has no obligation to provide maintenance or support services for Finvision and is not responsible for any claims by you or any third party relating to the App.
3. Finvision Gold — subscription
3a. What Gold includes
Finvision Gold is an optional, auto-renewing subscription that unlocks premium features including: Ask Penny AI, Proactive Coach notifications, Deep Month Recap, category projections, unlimited savings goals, and CSV data export. The exact feature set may change over time; material changes will be communicated with advance notice.
3b. Free trial
We may offer a free trial period for Finvision Gold. During the trial, you have full access to all Gold features at no charge. At the end of the trial, your subscription will automatically convert to a paid subscription at the then-current price unless you cancel before the trial ends. You will not be charged if you cancel before the trial expires.
3c. Pricing and billing
Subscription pricing will be displayed in the App and in the App Store listing before purchase. Prices may vary by country and are subject to change with notice. Your iTunes account will be charged upon confirmation of purchase. Subscriptions automatically renew at the end of each subscription period unless cancelled at least 24 hours before the end of the current period.
3d. Cancellation
You can cancel your Finvision Gold subscription at any time through your iPhone Settings → [Your name] → Subscriptions → Finvision. Cancellation takes effect at the end of the current billing period; you retain access to Gold features until that date. We do not offer partial refunds for unused subscription periods.
3e. Refunds
All purchases are processed by Apple. Refund requests must be submitted to Apple through the Report a Problempage or via Apple Support. We do not have the ability to issue refunds directly. Apple's refund policy applies to all transactions.
3f. Price changes
We may change the price of Finvision Gold at any time. Apple will notify you of price increases before they take effect and will require your consent to continue the subscription at the new price. If you do not accept the new price, your subscription will be cancelled at the end of the current period.
4. User responsibilities and acceptable use
You agree to use Finvision only for lawful purposes. You agree not to:
- Use the App in any way that violates applicable local, national, or international laws or regulations
- Attempt to gain unauthorised access to any part of the App or its related systems
- Use automated scripts or bots to interact with the App
- Interfere with or disrupt the integrity or performance of the App
- Use the Penny AI feature for any illegal, harmful, or abusive purpose
- Attempt to extract or reverse-engineer our AI systems or prompts
5. Intellectual property
Finvision, including its design, code, content, graphics, and Penny the owl mascot, is owned by Vegarise and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights in our trademarks, logos, or brand features.
Your financial data (transactions, budgets, goals) is yours. We claim no ownership over the data you create and store in the App.
6. Penny AI — disclaimers
Penny provides general financial commentary based on the data you input. Penny's responses are not financial advice and should not be relied upon as such. Finvision and Vegarise are not registered financial advisers, brokers, or investment managers. Always consult a qualified financial professional before making significant financial decisions.
AI responses may occasionally be inaccurate, incomplete, or outdated. You are solely responsible for decisions you make based on Penny's responses.
7. Disclaimer of warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
WE ARE NOT RESPONSIBLE FOR ERRORS IN YOUR FINANCIAL DATA, INCORRECT CALCULATIONS ARISING FROM DATA YOU ENTER, OR ANY FINANCIAL DECISIONS YOU MAKE BASED ON THE APP.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VEGARISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR FINVISION GOLD IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10 USD, WHICHEVER IS GREATER.
9. Indemnification
You agree to indemnify and hold harmless Vegarise and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the App in a manner not authorised by these Terms.
10. Age requirement
You must be at least 13 years old to use Finvision. By using the App, you represent that you are at least 13 years of age. If you are under 18, you must have your parent or guardian's permission to use the App and agree to these Terms on your behalf.
11. Termination
We may suspend or terminate your access to Finvision at any time, with or without notice, if you breach these Terms or if we discontinue the App. Upon termination, your license to use the App ends immediately. Your on-device data remains accessible to you until you delete the app.
12. App updates and discontinuation
We may release updates to Finvision from time to time. We encourage you to keep the App updated. We reserve the right to discontinue Finvision or any feature at any time. If we discontinue Finvision Gold entirely, we will provide reasonable advance notice and pro-rate any remaining subscription period where required by Apple's policies.
13. Governing law and dispute resolution
These Terms are governed by the laws of the jurisdiction in which Vegarise is established, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction, as required by applicable law.
For users in the European Union: Nothing in these Terms affects your rights as a consumer under applicable EU consumer protection law.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through an in-app notice or via the App Store update notes at least 30 days before taking effect. The “Last updated” date at the top reflects the most recent revision. Continued use of Finvision after updated Terms are posted constitutes acceptance.
